ІНСТИТУЦІЙНО-ПРАВОВІ ОСНОВИ ДИСЦИПЛІНАРНОЇ ВІДПОВІДАЛЬНОСТІ СУДДІВ

Анотація


Статтю присвячено аналізу розвитку організаційно-правових засад системи дисци­плінарної відповідальності суддів. Запропоновано порівняльно-правовий огляд формуван­ня відповідних інститутів у США та у європейських країнах. Встановлено, що у другій половині ХХ століття органи з питань судової поведінки США та європейські судові ради набули популярності як установи, що здійснюють дисциплінарні провадження щодо суддів. Незважаючи на жваву міжнародно-правову дискусію щодо запровадження судової ради в організаційну основу національного правосуддя, уточнено, що держави вправі встановлю­вати власну особливу систему судової дисципліни, зважаючи на національні традиції та потреби, за умови, що такий особливий шлях забезпечуватиме необхідний рівень судової незалежності. Це застереження залишається актуальним з огляду на від­чутну критику необережної практики запровадження європейської моделі судових рад у деяких країнах. Досліджено сучасний стан європейських стандартів щодо інституційного рівня системи дисциплінарної відповідальності суддів, зокрема, вимоги щодо судового та позасудового представництва у дисциплінарному органі, процесу формування складу дисциплінарного органу, його бюджету та форми зайнятості представників такого органу.
