«КЛАУЗУЛА ПРО КОНКУРЕНЦІЮ» В УГОДІ ПРО АСОЦІАЦІЮ МІЖ УКРАЇНОЮ ТА ЄС

Анотація

Досліджено правові механізми співробітництва Європейського Союзу та України з питань захисту конкуренції відповідно до Угоди про Асоціацію між Україною та Європейським Союзом. Доведено, що політика захисту конкуренції є головним елементом забезпечення функціонування зони вільної торгівлі.
У рамках розгляду кожної зі сфер правового регулювання конкуренції виокремлено конкретні пропозиції щодо удосконалення національного законодавства з метою імплементації Угоди про асоціацію (внесення змін до існуючих нормативно-правових актів та розроблення нових). У сфері удосконалення процедурних аспектів застосування норм конкуренції важливе значення має виконання принципу прозорості та аргументованості рішень АМКУ і судів у справах про узгоджені дії та концентрацію та їхня своєчасна публікація.
Охарактеризовано головні прогалини українського законодавства про захист економічної конкуренції, а також перспективи і тенденції розвитку правового забезпечення захисту конкуренції в Україні у зв’язку з набуттям чинності Угодою про Асоціацію між Україною та ЄС.

The article deals with the analysis of the EU-Ukraine Association Agreement and accents on its chapter on competition. It was proved that the competition policy is a core element for effective functioning of the free trade area between the EU and Ukraine. While reviewing each area of the competition regulation within the EU-Ukraine Association
Agreement, some specific suggestions were introduced with the aim to contribute to the improvement of the national legislation in order to develop the proper implementation mechanism for the fulfillment of the EU-Ukraine Association Agreement provisions on competition (f.e. amendments to existing legal acts and adopting new ones). The importance of the transparency and mandatory reasoning in the decisions of the Antimonopoly Committee of Ukraine decisions and courts practice in cases involving concerted actions and mergers are underlined as key features for the improvement of the procedural aspects of the enforcement of competition rules, as well as their timely official publication is seen to be the core element to secure the transparency and compliance with the EU standards in this field. The basic gaps of Ukrainian legislation on protection of economic competition were described. Some tendencies and perspectives for future regulation of competition matters in Ukraine were defined in connection with the entry into force of the EU-Ukraine Association Agreement.
The main directions of the approximation of the Ukrainian legislation to the EU legal standards on the protection of the competition are analyzed, which will be introduced in order to secure the due and diligent fulfillment of the mutual obligations arising from the provisions on competition
of the EU- Ukraine Association Agreement.
It has been noted that the main drawbacks of Ukrainian legal regulation of the competition matters constitute the lack of proper enforcement as well as the lack of the transparency both in the decision-making process on the competition issues and the subsequent enforcement of these decisions, including inter alia the lack of official publication procedures for the decisions of the national antitrust institutions.
