ПРАВОВІ ЗАСАДИ ФОРМУВАННЯ ДОХІДНОЇ ЧАСТИНИ БЮДЖЕТУ ЄС

Анотація

Розглянуто правові засади формування дохідної частини бюджету ЄС, проаналізовано положення правових актів первинного та вторинного законодавства ЄС, які регулюють формування дохідної частини бюджету ЄС. Особлива увага приділена питанням формування
системи власних ресурсів ЄС як основного складника дохідної частини спільного бюджету Союзу. Зокрема, досліджено правові передумови розвитку системи власних ресурсів ЄС, етапи її становлення та включення відповідних джерел до її складу.

The article is devoted to the legal basis of revenue of the EU budget; the acts of primary and secondary EU legislation governing the revenue of the EU budget are analyzed. Special attention is paid to the formation of the system of the EU’s own resources as a major component of the EU
budget revenues. In particular, the legal conditions of the system of own resources of the EU, the stages of its formation and incorporation of its appropriate sources are concerned.
The authors note that despite the obvious benefits, the current system the revenue of the EU budget has serious drawbacks, the main of which – a complicated correctional mechanism, used to return overpaid funds to states with a negative net balance in the common EU budget. A new Own Resources Decision adopted on 26 May 2014 introduces only some changes to the own resources system for the period 2014–2020 and the current system continues to apply until this new Council Decision is approved by every Member State.
