РОЛЬ І ЗНАЧЕННЯ СУДУ ЄС У СИСТЕМІ ОРГАНІВ ЄВРОПЕЙСЬКОГО СОЮЗУ

Анотація


Визначено роль Суду ЄС в інституційному механізмі Європейського Союзу. На основі аналізу його повноважень та повноважень інших органів ЄС досліджено засади та механізми співпраці Суду Європейського Союзу з іншими органами ЄС.

The article defines the role of the European Court of Justice in the institutional mechanism of the European Union. The Court of Justice of the European Union rules on the interpretation and application of Union law.

The Court of Justice of the European Union is responsible for ensuring the legality of the Union acts that the institutions of the European Union adopt. It ensures that the Member States fulfil their obligations under the Treaties. The Court of Justice delivers «preliminary rulings». It has contributed to strengthening the protection of fundamental rights by establishing that they are an integral part of the general legal principles of the European Union. The Court has no such jurisdiction with regard to national legislation lying outside the scope of Community law.

Based on the analysis of its powers and the powers of the other bodies of the EU the principles and mechanisms of cooperation between the European Court of Justice with other EU bodies are studied.
