СТАН ДОСЛІДЖЕННЯ РЕАЛІЗАЦІЇ ПРИНЦИПУ РІВНОСТІ У НАУЦІ КРИМІНАЛЬНОГО ПРАВА УКРАЇНИ

Анотація


Досліджено проблемні питання стосовно принципу рівності у науці кримінального права України. Наголошено на важливості вивчення цього питання з огляду на актуальні соціально-економічні проблеми в Україні. Проаналізовано численні наукові джерела, у яких простудійовано принцип рівності у різних його виявах. Досліджувані групи питань було згруповано за єдиним критерієм та послідовно показано у змісті статті. Встановлено, що питання, які у науці кримінального права України щодо принципу рівності вирішено однозначно, відсутні. Виявлено питання, які залишаються дискусійними у науці кримінального права України відносно реалізації принципу рівності. Показано зв’язок між розумінням принципу рівності у науці кримінального права України та наслідки незастосу­вання чи неправильне застосування розроблених наукових підходів у законодавчій діяльності. Зроблено висновки, у яких відображено проблеми, що взагалі не вирішені нау­кою кримінального права України стосовно принципу рівності, однак вони є актуальними.
