ТЛУМАЧЕННЯ МІЖНАРОДНИХ ДОГОВОРІВ

Анотація

Досліджено найважливіші питання тлумачення міжнародних договорів. З’ясувано специфіку тлумачення міжнародних договорів, укладених багатьма мовами. Наявність особливостей договору, зумовлених його багатомовністю, робить багатомовний договір специфічним об’єктом тлумачення. Для вирішення цього завдання зосереджено увагу на таких загальнотеоретичних проблемах тлумачення міжнародних договорів: понятті тлу­мачення міжнародного договору, принципах, видах та способах тлумачення міжнародних договорів. Специфіку багатомовного тлумачення відображено у принципах: максимального використання текстів договорів різними мовами; однакової достовірності текстів, автен­тичність яких встановлена різними мовами; встановлення єдиного змісту, закріпленого в текстах різними мовами. Констатовано, що вихідною позицією у тлумаченні багатомовних договорів є презумпція однакового значення термінів та єдиного змісту текстів, поданих різними мовами. З’ясовано, що тлумачення текстів міжнародних договорів різними мовами найдоцільнішим є застосування загального семантико-правового підходу.

The article is dedicated to the most important issues of interpretation of international treaties. The aim of investigation is to clarify the specificity of interpretation of international treaties in different languages. Approaches of various scholars to interpretation of international treaties differ a lot. Some authors do not accept specificity of interpretation of treaties in many languages and believe they should be interpreted according to general rules. Others admit peculiarities of interpretation of multi-language treaties, but at the same time they lack clearness in solving the problem of using one or another means of interpretation of treaties of this kind. Taking into account ambiguity of interpretation of international treaties, this article focuses on the following general theoretical problems of interpretation of international treaties: notion of interpretation of an international treaty, principles, types and ways of interpretation of international treaties. Specificity of multi-language interpretation is reflected in principles of maximum usage of multi-language treaties texts; similar credibility of texts, authenticity of which is proved in different languages; adjustment of common content which is fixed in texts in various languages. These regulations are provided in Vienna Convention on the right of international treaties (1969) and in amendments of the Conference (1986). Practical usage of interpretation rules does not differ according to participants, object and other peculiarities of international treaties. The conclusions state that the primary attitude in interpretation of multi-language treaties is presumption of the same meaning of the terms and the same meaning of common content of texts in different languages. Interpreting texts of international treaties written in different languages it is the most advisable to use general semantic-legal approach.
